PirateBay servers seized.

Tomasz Rychlicki @ 31.05.2006

Read the articles on www.slyck.com and www.wiredfire.org websites. What is more interesting the Swedish Police does not know if there is something illegal. I wonder when they will start to shoot and then ask questions?

The good reputation of Bolek i Lolek

Tomasz Rychlicki @ 31.05.2006

Editors of a German gay magazine titled "Siegessaeule" used on its cover (JPEG, 151 KB) images of characters of Polish famous cartoon. A group of Bielsko Biała citizens (the city this cartoon was produced) protest against the usage of Bolek and Lolek images in promoting gay and lesbian movement in Warsaw called Equal Parade. They formed the "Initiative to protect Bolek and Lolek images, Bielsko-Biała 2006". More details in the article on www.onet.pl website (in Polish, sorry).

Web4.0

Tomasz Rychlicki @ 31.05.2006

Couple of websites connected with the Web 2.0 issue. Service mark application no 78322306. Cory Doctorow's remarks on www.boingboing.net website and Marty Schwimmer's reflections on www.schwimmerlegal.com website. Out of the topic and about patents. US patent no 4,698,672, for "JPEG format" (which I use in the topic of this news) was rejected (to be precise some claims). More details on www.pubpat.org website.

The CFI judgement.

Case T-15/05, De Waele vs. OHIM.

Web3.0

Tomasz Rychlicki @ 31.05.2006

Two points of view. Comments on www.tomrafteryit.net website and somehow a reply to this whole issue on www.oreilly.com website. The term Web 2.0 is just another buzz word for me (and as I know it sells well between lawyers and marketing stuff and suits well for them as a service mark). I have no idea if the USPTO will register it. American common law allows to "appropriate" such description. Anyway IMHO it is O'Reilly' own goal (suicide goal). I recommend you to download a Web 2.1 update from www.designlaw.org website and check www.userfriendly.org comments too.

section

Tomasz Rychlicki @ 26.05.2006

Vagla bought a tablet and draws comics on his www.prawo.vagla.pl website and I started to make illustrations on this one. You can see the example above as a subject. But I wanted to write about another issue here. Maybe there is a chance that we will know how is the law lobbied on the European Union level. Check www.ec.europa.eu/comm/eti website dedicated to law making transparency in the EU. I recommend a lecture of the Green Book titled "EUROPEAN TRANSPARENCY INITIATIVE". I wonder why is this strategic plan for 2005-2009. How it was done before? I have such reflections concering new legal initiatives on Community Patent regulations. From the other hand check the analysis on wiki.ffii.de website.

DaVinci

Tomasz Rychlicki @ 25.05.2006

There are releases such as The.Da.Vinci.Code.TELECINE.XVID-PUKKA seen on the net. It is only a telecine version so "pirates" promised better quality source soon. Check the post on www.cdfreaks.com website. About the level of "piracy" in Poland you may read in the annual BSA study avaliable on www.bsa.org website. Can some teach this organization PR stuff/executives etc. what is the real meaning of the piracy and what are crimes against intangible goods/rights (know as IP rights)?

Battlefield2 mix.

Tomasz Rychlicki @ 25.05.2006

The promo of bunny hooping in the Battlefield 2 game with a connection to Sony Bravia advertising is in the movie on www.video.google.com website.

Prawie jak oryginał - almost like original.

Tomasz Rychlicki @ 25.05.2006

The European Commission, governments, organizations and societies, trade mark attorneys, all of them fights with products/trade marks counterfeiting. There are plans to amend the industrial property law and on the EU level some directives are proposed. Meanwhile just see as a perfect comment the movie on www.video.google.com website. As a consumer I hate counterfeited stuff.

It is not Sony Bravia promo.

Tomasz Rychlicki @ 25.05.2006

Check www.swansea-res.org.uk website, especialy its download section. Someone took the Sony Bravia idea (the original advertising movie is avaliable on www.youtube.com website). We are wondering with Marcin (respect) about the reason of such action. Allegedly an organization is protesting about something but they make avaliable a real high quality video to the public on its website. Whois (details on www.youtube.com website) is prompting on advertising agency website - www.chiadvertising.com. Viral marketing. Perfect job. Wanted is delighted with the webmaster's job. This www.swansea-res.org.uk website layout looks like from the 90'ies. Super fake. Will Sony undertake any legal move?

Alicante news.

Tomasz Rychlicki @ 24.05.2006

Illegaly copied books.

Tomasz Rychlicki @ 18.05.2006

There are posters (JPG, 100 KB) hanging at Polish Universities. This picture was taken in the library of the University of Gdansk Law Faculty building (sic!). Watchowrds on this poster are, let's say "debatable". From the other hand Police officers from the Section for Economy Crimes from Wrocław City Police HQ arrested a man who distributed illegaly copied books. More details on www.dolnoslaska.policja.gov.pl website (in Polish).

The Court of Justice of European Communities judgements

Tomasz Rychlicki @ 16.05.2006

Case C-416/04, Sunrider v. OHIM.
Case T-279/03, Eurohypo v. OHIM.

Makes a difference.

Tomasz Rychlicki @ 10.05.2006

Comparative advertising is allowed in Polish and EU law. I think information in this movie also. This parody is associated with advertising of Polish beer brand caled "Żywiec". It was based on a movie with the slogan "prawie jak ..., prawie robi wielką różnicę" which is translated "almost as ..., almost makes a great difference".

Geographical Indications.

Tomasz Rychlicki @ 05.05.2006

The Polish Patent Office organized on April 26, 2006, a seminar on "Protection of Geographical Indications - Poland's challenges after the EU's accession". Thre are some materials on www.uprp.pl website.
