I was searching for free e-books when I found this release The.American.Language.of.Rights.eBook-EEn. In this directory there was a file (e-alangr.zip) packed with WinZip software. I unpacked it. There were such files as ALANGR.RAR, ALANGR.SFV, FILE_ID.DIZ, THEAME~1.NFO and eengrf01.gif. It was obvious for me that ALANGR.RAR contains packed with WinRar an ebook in the PDF file named The.American.Language.of.Rights.eBook-EEn.pdf, not to mention what SFV, DIZ and NFO were for. I was more concerned about the GIF file with the comic. Does it violote the copyright law?

Two months ago I wrote about Mcrosoft's infringement of a trademark from www.zlotarybka.pl website. Microsoft settled with Sławomir Rybka (owner of the website, Country Dreamer on duty). Microsoft's official press release (Polish language). The company will help Mr Rybka to fulfill dreams of people who visit his website.

Chancellery of the Sejm (Sejm is the lower house of the Polish Parliament) gave a copyright note to the text file of the Act from 4 February 1994, on Copyright and releated rights. The mentioned file is avaliable to download on isip.sejm.gov.pl website (PDF). Some questions arise. If the article 4 of this Act explicty says that legal texts and drafts of such texts are excluded from copyright works why someone tries to claim a copyright to it? The Second question is (I know I am guilty too if you look at the footnote of this website) why to put ©, if the article 1, section 4, clearly sets that copyright protection is established without any formalities?

I wrote about the game "Marc Ecko's Getting Up Contents Under Presure" in January. This game was pirated yesterday as MARC.ECKOS.GETTING.UP.CONTENTS.UNDER.PRESSURE-DEViANCE release.
It was not done properly due to some problems with the SafeDisc 4.60 protection scheme (one of the DRM systems existing in the average effectively way for a long time). You can notice such release as MARC.ECKOS.GETTING.UP.CONTENTS.UNDER.PRESSURE.CRACKFIX-DEViANCE being released later.

Some Polish prosecutor charged a person for illegaly getting a computer software distributed on GNU General Public Licence to the detriment of the "GNU General Public Licence Free Software Foundation Inc. firm". The article on www.rzeczpospolita.pl website about the Polish Central Administrative Court judgement (sygn. II GPS 1/05). The Court decided about the Polish industrial property law conforming to the TRIPS requirements. The issue was related to the changes in patent rights period of patents granted before Poland joined the WTO. The prior patent law protection period was 15 years. The action was brought by the Boots Company PLC as an appleation from the Polish Patent Office refusal to extend patent protection covering the Boots Company invention. The Court reversed the PPO decision and ordered to extend patent rights period to twenty years.

There is an article on www.rzeczpospolita.pl website about Polish Supreme Court's judgement (sygn. I CK 281/05) in which the Court has made a wide interperetation of th article 1 of the Polish copyright law. The Act from 4 February 1994, on Copyright and releated laws. The text is avaliable in the publicator Dziennik Ustaw z 2000 r. No 80, pos. 904, with later amendments. The Court based it's findings on the argument that, commonly know ideas and commonly known data/informations may be protected by the law as a copyrighted work if they are expressed in the original form with the individual creativity element. The subject of a copyright work was a handy calorie's meter. Grażyna D. was an owner of a design done by Wojciech D. The designer sold to Grażyna D. all his property rights. Grażyna D. owns a company which manufactures such products. She was contacted by Unilever Polska SA about this product. She responded by fax but received no answer. Unilever started to deliver butter products with handy calorie's meters attached to it on the market some time after the unfinished talk. Grażyna D. sued the Company and has lost the first case and the appelation. The Polish Supreme Court reversed the judgement and ordered to reconsider the case.
