New guidelines for business method patents.

USPTO released a new business method guidelines on its www.uspto.gov website (PDF) file. Those guidelines are combined with the precedential decision Ex parte Lundgren, Appeal No. 2003-2088 of the Board of Patent Appeals and Interferences. The BPIA eliminated "technical arts" requirements in the scope of business method patents (Title 35 U.S.C. § 101) in this opinion.

The Kingdom of Nepal access to the Berne Convention for the Protection of Literary and Artistic Works of September 9, 1886, as revised at Paris on July 24, 1971, and amended on September 28, 1979. WIPO's official press release.
The Berne Convention will enter into force, with respect to the Kingdom of Nepal, on January 11, 2006. On that date, the Kingdom of Nepal will also become a member of the International Union for the Protection of Literary and Artistic Works ("Berne Union"), founded by the Berne Convention.

The district court in Poznań ruled that the furniture's design is protected by the copyright law. The article on www.rzeczpospolita.pl website (sorry English readers, it is in Polish language and I will not summarize it) about the Province Administrative Court judgement (sygn. VI SA/Wa 882/05) in case which was an appeal from Polish Patent Office decision refusing to register a trademark "100 crosswords with a smile". The Court overruled the mentioned decision in its judgement. The Polish Patent Office will have to consider the trademark application one more time.

The Polish Central Administrative Court (I am not sure if I translated the Court's name properly - Naczelny Sąd Administracyjny) has issued a judgement in the case sygn. II GSKL 195/05. This case is based on the appelation from the Province Administrative Court. The Court ruled about the scope of representation of patent attorneys and patent law firms on behalf of registering trademarks in the interest of the patent attorney, patent firm or a secret/hidden client. More details in the article on www.rzeczpospolita.pl webiste (in Polish, sorry). The Court reversed the appeal which was issued in favour of patent attorneys/patent firms. The judgement was based on the conclusion that all legal plenipotentiaries should only act on someone's behalf. The attorney can not act on its behalf and in fact acting on behalf hidden/secret client.

US Patent Office has put some movies about IP issues, (so far 3 movies for Real Player, Real Media Video, by the way I recommend the Real Alternative 1.43 codec, and its mirrors) on its www.uspto.gov website. Very interesting initative IMO, worth checking. If you prefer downloading those movies rahter than streaming please check software on www.netxfer.com website. It is designed for downloading Real Media and other movie formats instead of streaming.
