Short news (published in "Wiadomości regionalne" part of "Gazet Pomorska" newspaper from January, 24 2005), that makes happy. I will cite the full story. The Police arrested 43 years old man selling counterfeited clothes with famous trademarks in Saturady at the marketplace at Targowa street in Świecie. Four sweatshirts were found with the perpetrator. The suspect was released after interrogation.

Our local monopoly was too clever. Check the artcicle on www.chip.pl website (sorry it's in Polish). Generally speaking it's about illegal actions taken by Polish ccTLD Register against domain users. The court ruled in favour of a user who works for Chip and had registered www.shareware.com.pl domain name. He had this domain for short time and then abandoned it. He decided to stop paying, (his decision was based on NASK regulations about consumer contracts) hoped to be deleted from the register. NASK tried to force him to pay even for the time he didn't use the domain. I got the same problem with NASK. So far they did not sue me but I wait to have some fun in a court.

Subject of software patents law is very "hot" in European Union lately. Some of You may wonder from where did come this tendency. The answer is very short. USA legal system was very liberal about those issues at the begining. First very important judgemnt came in Diamound v. Chakrabarty, 100 S.Ct. 2204 (1980) case. USA Supreme Court precisely said (based on Congress historical materials about patent law legislation) that "anything under the sun that is made by man" can be patented, I wrote short info about this case in January, 2004. Shortly after this case, about one year after USA Supreme Court gave another important judgment in Diamond v. Diehr, 450 U.S. 175 (1981) case. In dictum of this judgment You may read a lot of interesting things about patentability of software inventions. This judgment was the key for todays USPTO policy about granting software patents. I need to mention that this policy is under hard criticism in USA. Big software companies which try to monopolize fields of their activity started legal lobbying in European Union to bring such solution in European internal/common market. Please read obiter dictum of both judgments to learn more about such law policy in USA.

Szulc-Efekt transfered for free www.mercedes.com.pl domain on DaimlerChrysler AG (see scanned document) in 2001. The organization responsible for transfering is NASK (they manage *.pl and *.com.pl ccTLD). Since 2003 DaimlerChrysler AG started to sent mails to Szulc-Efekt Comapny demanading such transfer in German language. Very strange because translations are not so expensive (pardon my malicious comment) and what is more important such transfer was done 2 years ago.

Beacuse the computer may be used as a machine to copy copyrighted material, Munich distric court ruled that Fujitsu Siemens must pay "piracy" tax for each machine (12 Euro, $16).
